Terms & Conditions

Welcome and thank you for visiting my website. These terms are here to make sure we're on the same page when you buy something from me. I've tried to keep them clear and fair. If anything is unclear, just reach out and I'll be happy to explain.

1What I sell

1.1

I offer my work in three forms:

Original artwork is one-of-a-kind and made by hand.

Limited edition prints are numbered, signed by hand and produced in a stated maximum quantity. Once an edition is closed, I will not reissue the same hand signed and numbered prints. The stated edition size is final.

Open edition prints are not hand signed or numbered. They are printed to order.

1.2

I may offer variations of the same artwork in different forms. An original may also be released as a print and a limited edition print may also be released as a non-hand-signed open edition.

2Orders

2.1

You place an order and pay through the checkout on this website. The agreement between us is complete once your payment has been received and you have had an order confirmation from me by email.

2.2

If there is a pricing or availability error on my end, I may need to cancel your order and refund you in full. I'll always contact you first.

2.3

Orders are processed and shipped within 3 weeks, unless I let you know otherwise.

2.4

Shipping is free worldwide.

2.5

Any customs duties or import taxes that may apply in your country are your responsibility. I have no control over those.

3Prices and payments

3.1

All prices shown are the full price you pay. They include any applicable taxes and shipping. There is nothing added at checkout.

3.2

I accept various payment methods. Please make sure your payment details are correct when placing an order.

4If something arrives damaged or wrong

4.1

I take the utmost care when shipping your product. If something arrives damaged or is wrong, please let me know within 14 days of receiving your order and send me a photo of both the item and the packaging.

4.2

For prints, you will receive either a refund or a replacement. If I ask you to return the print, I'll cover the return shipping.

4.3

For originals, we'll agree on the best solution together, which may be a repair, a refund, or something else.

5Changing your mind if you are in the EU

5.1

You have a legal right to withdraw from your purchase within 14 days of receiving it, without giving a reason. To use it, just email me at esther.marjolein.vdm@gmail.com before the 14 days are up. You can use the model withdrawal form if you prefer, but a plain email is fine.

5.2

Once you've told me, send the item back within 14 days. Please send it back in the original packaging if you can. You are responsible for any loss in value caused by handling beyond what is needed to inspect the work. I'll refund you the purchase price upon receipt, but return shipping is at your own cost.

5.3

Original artwork is excluded from this right where it was made or personalised to your specification, such as a commission. Other originals can be returned under this section.

6Changing your mind if you are outside the EU

6.1

You don't have a statutory withdrawal right, but I strive to have happy customers only. Prints can be returned within 14 days of receipt if they are unused and in their original packaging, with return shipping at your own cost.

6.2

Original artwork is excluded from this right unless it arrived damaged or doesn't match what you ordered (see clause 4).

7A note on colour

7.1

When working with oil paint, I use a range of pigments, each with its own reflective qualities. This means the way you perceive the colours depends on the lighting and surroundings. A painting can look quite different depending on the room you hang it in and the time of day.

Furthermore, screens vary and are backlit. Therefore, colours you see on your device may look slightly different from the physical work. If colour accuracy matters to you, please ask me for extra photos or a short video before purchasing. I'm always glad to send them.

7.2

Prints are produced in batches, so there can be minor variation in colour and paper tone between one batch and another. This is normal for fine art printing and is not a fault.

8Delivery issues

8.1

If delivery fails because of an incorrect address on your end, I will ask you to cover the cost of re-delivery. If the mistake was mine, I'll take care of it.

8.2

If a package arrives at a pickup point and isn't collected in time, I will leave arranging a new delivery up to you.

9Copyright

9.1

All artwork on this website is protected by copyright. Buying a piece means you own the physical work, but not the rights to the image.

9.2

By accepting these terms and conditions, you agree to not reproduce my works commercially and to not upload them into AI systems in any way, shape or form.

10Commissions

10.1

For commissions, we'll agree on subject, size, medium and price before I start. Most commissions take 4 to 12 weeks.

10.2

A 50% deposit is required to begin. This deposit is non-refundable if you cancel for reasons unrelated to my work.

10.3

The remaining balance is due before shipping.

10.4

If I'm unable to complete the work as agreed, you'll receive a full refund.

10.5

Because a commission is made to your specification, the withdrawal right in sections 5 and 6 does not apply. Section 4 does: if the work arrives damaged, I'll take care of it.

11Governing law

11.1

These terms are governed by Dutch law.

11.2

If something goes wrong, I hope we can sort it out directly. If we can't, Dutch courts will have jurisdiction.

I work from a studio in Amsterdam, the Netherlands. My registered business address is held with the Dutch Chamber of Commerce and is available on request.
